Successful restructuring with Noerr
With the support of the Noerr Group, the in-court restructuring of Küppersbusch Großküchentechnik has now been successfully completed. The court concluded the Protective Shield Proceedings at the end of December with the agreement of the creditors.
Noerr acted for the Dutch sole shareholder TEKA B.V., a leading European manufacturer of domestic and kitchen appliances, which actively supported the restructuring. Küppersbusch continues to be part of the TEKA Group. Under the leadership of insolvency partner Dr. Thomas Hoffmann, a Noerr team advised the shareholder comprehensively on all legal questions in connection with the restructuring of the Gelsenkirchen company. In the preparation for the Protective Shield Proceedings, Noerr Consulting AG with auditor Andreas Sand played a crucial part. Noerr Consulting prepared the certificate under §270b Insolvency Act required for the commencement of the Protective Shield Proceedings and thereby provided the basis for the successful restructuring of the kitchen manufacturer. Noerr Consulting AG specialises in financial and management restructuring advice.
Following the Küppersbusch application in June 2013, the Protective Shield Proceedings were opened on 1 September. Michael Mönig of mönigundpartner Rechtsanwälte was appointed administrator. For the self-administration, Dr. Stefan Weniger of hww Unternehmensberater was appointed managing director.
In restructuring and insolvency, Noerr is among the leading law firms and, particularly in recent times, has dealt with many major cases including the successful restructuring of centrotherm photovoltaics AG, advising the insolvency administrator of Q-Cells (now: Global PVQ SE i. I.) on the sale of the subsidiary Solibro and various solar farms or the insolvency administrator Frank Schmitt on the sale of the Frankfurter Rundschau to FAZ.
