Ludek Chvosta

Luděk Chvosta focuses on banking and finance work (including regulatory aspects), capital markets (with an emphasis on DCM), insolvency law and litigation. As Luděk is qualified as an Attorney & Counselor-at-Law in the State of New York, an Advocate in the Czech Republic, an Attorney-at-Law in Washington DC and a Solicitor in England & Wales, he can offer unique multi-jurisdictional insight into key financing issues and their business impact. Furthermore, he has acted on many of the top Czech capital markets deals of the past decade and has represented creditors in some of the most well-known insolvency proceedings in the Czech Republic.

Ludek has acted for, inter alia:

  • USD 160 mil. re-financing of loan facilities provided to CIS sovereign railway operator (2017)
  • EUR 100 mil. loan facility to private investment vehicle with complex third-party Luxembourg funds security structure (2016)
  • EUR 80 mil. senior secured margin loan facility for funding of acquisition of shares in German joint stock company (2016)
  • EUR 500 mil. refinancing of loans extended to major European logistics park group (2015-2016) Acted for bank syndicate (Česká spořitelna, a.s. and Commerzbank AG) on untested and unique pre-pack reorganization of a leading Czech engine components manufacturer (Motorpal, a.s.) and settlement of obligations vis-à-vis its syndicate of secured lenders (2015-2016)
  • Acted as transaction counsel on various private and public bonds issues by nano-textile manufacturer Pegas Nonwovens entities (2014, 2015, 2017)
  • Acted as transaction counsel on various bonds issues of real estate developer Passerinvest Group (2014, 2016-2017)
  • Advised on regulatory and capital markets issues of major cross-border international credit institution merger (2016)
  • Historically first German NSV (Namenschuldverschreibungen) issues by Czech issuer (2010-2011, subsequent NSV/IHS issues by state-controlled entity in 2014, 2015)
  • Acted for UniCredit Bank Czech Republic and Slovakia, a.s. as secured creditor in a protracted three-year insolvency proceeding regarding failed shopping mall development and advised on satisfaction of claims in an amount exceeding CZK 1.8 bn. (2010-2013)
