International Dispute Resolution in Brazil, Germany and Russia

After having invested BRL 25.6bn (approx. EUR 8.6bn) in infrastructure and stadium construction for the World Cup 2014 and successfully hosting the tournament, Brazil will certainly continue to experience major construction projects as well as the inevitable disputes resulting from the increasing number of projects in the construction industry.

In various cases, arbitration will be the most suitable dispute resolution mechanism in disputes between Brazilian and German entities. The arbitration laws of both countries provide for an arbitration-friendly background. The Rio Olympic Games 2016 are likely to further foster cooperation and economic relationships between Brazilian and German companies. Therefore, the participating companies are well advised to implement tailored arbitration & ADR tools in their contracts.

Also in Russia, arbitration has become the preferred dispute settlement mechanism for foreign investors in recent years. In line with this trend, Russian court practice has been undergoing substantial changes which are of importance for current and potential investors.
