Reform of D&O liability law: Lively discussion at the 70th Convention of the Association of German Jurists continued at the 9th Noerr Autumn Insurance Law Conference

The reform of D&O liability law was not only the focus of the 70th Convention of the Association of German Jurists (70. Deutscher Juristentag) held in Hanover in September 2014, but also the subject of lively discussions at the 9th Noerr Autumn Insurance Law Conference: some experts see D&O liability as being too strict in particular for stock corporations. Deficits with respect to the instruments available for asserting claims are also criticised.

The opportunity to deepen the discussions during the Convention of the German Association of Jurists and to take a critical look at the resolutions adopted there was used by the more than 140 participants in the Noerr conference held in the middle of November (12 November in Düsseldorf and 18 November in Munich). The discussions held at the Convention and at the Noerr conference also showed that the importance of D&O insurance in connection with directors’ and officers’ liability cannot be overemphasised. Participants in the Noerr conference again included top representatives of the legal and claims departments of insurance and reinsurance companies such as Allianz, HDI-Gerling, Munich RE and Swiss RE.

With Prof. Dr Gregor Bachmann (Freie Universität Berlin, expert for the reform of D&O liability law) and Dr Peter Hemeling (General Counsel, Allianz), Oliver Sieg, Thomas Heitzer, Tanja Schramm, Helmut Katschthaler and Henning Schaloske also had excellent speakers on board, whose speeches were both profound and practical and who answered numerous questions from participants. These speakers had already shaped the discussion at the 70th Convention of the Association of German Jurists.
