No application of section 215 German Insurance Contract Act to claims by a legal person
Policyholders are now given the option by section 215 German Insurance Contract Act of pursuing a claim at the court responsible for their place of residence. In this case, a legal entity filed a claim at the court responsible for its registered office. The provision in section 215 German Insurance Contract Act, however, according to the judgment of Regional Court Ravensburg, does not apply to a claim by a legal entity. The personal area of application of the standard is not open to legal entities. Direct application is excluded due to the lack of a place of residence or an alternatively appropriate habitual residence. In the view of Regional Court Ravensburg, an extended application of the standard to a registered office runs counter to the intent of the standard, which was to protect consumers.
