The LG Hamburg dismisses claim for feed-in fees

The LG Hamburg dismissed the cartel law discrimination and abuse claim of the regional cable network operator wilhelm.tel against ZDF for payment of feed-in fees. In the grounds of the judgement, the court stated that ZDF is not a dominant customer on the relevant market for feed-in services. Previously, the OLG Düsseldorf in a parallel cases decided that ZDF had neither a market dominance nor a strong market position as a customer for signal feed-in services and in any event non-payment of feed-in fees did not constitute abuse of market power.
