European Commission: Proposal for a Digital Omnibus Regulation

The European Commission has recently published a “Digital Omnibus Regulation Proposal”.

Through this legislative package, the Commission intends to optimise and streamline the EU’s digital rulebook in order to boost the competitiveness of businesses in the EU.

The proposal includes numerous amendments to the General Data Protection Regulation (GDPR), which is effectively applied since 2018. The AI Act, which was only adopted in 2024, is also to be amended. Additionally, the Data Act, applicable only since September this year, the Data Governance Act (DGA), applicable since 2024, and other European legal acts on data are to be consolidated into a new, more comprehensive Data Act.

The Commission’s proposal would significantly reshape the current map of European data law:

While the Commission’s ambitious legislative project has met with fierce criticism in some parts of the public debate, it has also received support. It remains to be seen whether, and in what form, the legislative package will make its way through the forthcoming trilogue with the Council and Parliament.
