The financial sector in Germany and the EU has undergone significant changes in recent months and years and the regulatory environment continues to evolve. Increased digitalisation in the financial sector is reflected in several recent regulations, including DORA, MiCAR as well as a comprehensive AML package. While this trend of tightening the financial regulatory regime has continued over the past few years, an opposing development has recently emerged that emphasises the principles of proportionality and deregulation.

Jens H. Kunz and Klaudyna Lichnowska from our Financial Services Regulation practice group worked together with Global Legal Insights (GLI) and contributed the German law chapter to the multijurisdictional compendium “Banking Regulation 2026”. The contribution outlines the financial regulatory architecture in Germany, including banking governance, internal controls and bank capital requirements. It also addresses key regulatory developments in the financial sector, including on digitalisation, crypto assets, artificial intelligence, digital operational resilience/DORA and ESG/sustainable finance.
