Noerr advises ISS Facility Services on taking on 3,000 STRABAG employees

16.04.2018

Noerr has once again advised the Danish services group ISS Facility Services on a complex transaction in Germany. ISS is taking over a business division with 3,000 employees from STRABAG. They will continue to provide services for Deutsche Telekom at their new employer ISS Facility Management. Besides the employees, incident management centres are also being transferred, which are essential for the operation of the Telekom buildings and systems. The takeover follows a change of service provider by Deutsche Telekom: from July 2019, ISS will provide integrated facility services for Deutsche Telekom at approximately 9,000 locations across Germany.

ISS and STRABAG have been negotiating since the end of last year on options for the continued employment of more than 3,000 employees of STRABAG Property und Facility Services GmbH (SPFS) and STRABAG Facility Services GmbH (SFS) who are deployed at Deutsche Telekom. The constructive discussions have now been successfully completed with the agreed takeover. The STRABAG employees will receive an offer of further employment from ISS as of 1 July 2019. The agreement facilitates a socially acceptable transfer of the employees and safeguards the employees’ many years of know-how for ISS and Deutsche Telekom.

The Noerr partners Christoph Spiering (Corporate/M&A) and Stefan Schwab (Employment & Pensions) headed the team which advised ISS Facility Services. The team had already advised ISS on the conclusion of a contract package with Deutsche Telekom. Noerr regularly acts for the world’s leading provider of facility services, for example by advising it on the takeover of the specialist services provider Evantec from palero and the takeover of Vattenfall’s facility management in a structured tender procedure.
