HD+ brings top football to fans’ homes with Noerr’s help

Noerr has advised HD PLUS GmbH on the conclusion of an agreement with Discovery Communications Europe to market the Eurosport package. The package lets HD+ customers watch Bundesliga matches and other sports events.

The package covers the new pay-per-view channel Eurosport 2 HD Xtra and access to the Eurosport Player streaming service. The new broadcaster shows over 40 Bundesliga matches live, including all Friday and Monday matches, other Sunday fixtures, relegation play-offs for the 1st and 2nd divisions plus other sporting events.

The Discovery channel subsidiary Eurosport last year won the rights to broadcast the Bundesliga matches now also receivable via HD+. In a contract award process, Deutsche Fußball Liga (DFL) had put the Bundesliga rights for the seasons 2017/18 to 2020/21 out to tender. A team led by competition lawyer Dr Kathrin Westermann had previously successfully advised DFL and Ligaverband in the antitrust office proceedings on the tendering of media rights.

HD PLUS GmbH, a wholly owned subsidiary of the satellite operator SES, markets the HD+ product, an additional range of channels in high definition. HD+ has relied on Noerr’s legal expertise since its founding in 2009. The firm advises HD+ not just on drafting contracts with the participating broadcasters and cooperation partners for the HD+ platform, but also on regulatory matters of telecommunications and media law, preparing licensing contracts with receiver manufacturers and the sale of HD+ cards.
